These Terms & Conditions (“Terms”) govern your use of artifyimages.com and your purchase of digital artwork from Artify Images (“we,” “us”). By using the website or placing an order, you agree to these Terms.

1. Products

We sell digital artwork files, delivered as downloads. Our collection includes original digital works, AI-assisted illustrations created in the tradition of historical botanical and natural-history plates, restorations of public-domain works, and unmodified reproductions of public-domain works. Each product page states which type of piece it is. Product images on the website are previews; the file you download is the high-resolution version described on the product page.

2. Orders, pricing, and payment

  • All prices are in U.S. dollars. We may change prices at any time, but changes won’t affect orders already placed.
  • Payment is processed securely by Stripe. Your order is confirmed when payment is approved.
  • We may refuse or cancel an order in cases of suspected fraud or an obvious pricing error. If we cancel a paid order, we will refund you in full.
  • You are responsible for any taxes or fees that apply to your purchase where you live.

3. Delivery

Downloads are available immediately after payment, through the link on your order confirmation page and in your confirmation email. If you created an account, you can also find your files under My Account → Downloads. Files are delivered as high-resolution JPEG images (collections are delivered as a ZIP file). Each purchase allows 5 downloads within 30 days of purchase, so please save your files somewhere safe right away.

Immediate delivery. By completing your purchase, you ask us to deliver your digital files immediately, and you acknowledge that once delivery has begun, you lose any legal right to cancel the order that may otherwise apply where you live (for example, the 14-day withdrawal right for consumers in the European Union and United Kingdom).

4. License to use the artwork

When you buy a file, you are buying a license to use it, not ownership of the artwork or its copyright. Unless a product page or separate written agreement says otherwise, your purchase includes a personal-use license, which is non-exclusive and non-transferable.

You may:

  • Print the artwork for your own home or personal space, in any size.
  • Display the file digitally for personal, non-commercial use (for example, on your own screen or digital frame).
  • Give a print you made as a personal gift.

You may not:

  • Sell, share, or give away the digital file, or post it for download.
  • Sell prints, or use the artwork on products for sale (for example, apparel, mugs, cards, or print-on-demand items).
  • Use the artwork in advertising, branding, logos, or any commercial project.
  • Claim the artwork as your own, or remove any credit or watermark included with it.
  • Use the files to train artificial-intelligence or machine-learning models, or to create NFTs.

5. Intellectual property

The website, its design, text, and our original works, AI-assisted illustrations, restorations, and digital files are owned by or licensed to Artify Images. Where a work is based on a public-domain source, the underlying historical work remains in the public domain; these Terms govern your use of the files we create and sell.

6. Refunds

Because digital files are delivered instantly, all sales are final except as described in our Refund Policy, which is part of these Terms.

7. Colors and printing

Colors can look different on different screens and printers. We are not responsible for printing results, or for the cost of prints made by you or a third-party print shop.

8. Your account

If you create an account, keep your login details secure. You are responsible for activity under your account. We may suspend accounts that are used to violate these Terms.

9. Acceptable use

You agree not to misuse the website, including by attempting to access it without authorization, interfering with its operation, or scraping or bulk-downloading its content.

10. Disclaimers

The website and products are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties not expressly stated in these Terms, including implied warranties of merchantability and fitness for a particular purpose.

11. Limitation of liability

To the fullest extent permitted by law, Artify Images will not be liable for any indirect, incidental, or consequential damages arising from your use of the website or products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order.

12. Governing law

These Terms are governed by the laws of the State of Florida and applicable U.S. federal law, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Florida, unless the law where you live requires otherwise.

13. Privacy

Our Privacy Policy explains how we collect and use your information.

14. Changes to these Terms

We may update these Terms from time to time. The version in effect when you place an order applies to that order.
